End User License Agreement (EULA)

IMPORTANT – READ CAREFULLY:

This End User License Agreement ("Agreement") is a legal agreement between you ("User") and ScanMy.Band ("Provider", "we", "us", or "our") for the purchase and use of an NFC medical identification wristband and access to a related web application ("WebApp") that allows the User to personalise the wristband\'s functionality.

By purchasing, activating, or using the NFC wristband and WebApp, the User agrees to be bound by the terms of this Agreement and the ScanMy.Band Privacy Policy.

1. License Grant

We grant the User a limited, non-exclusive, non-transferable license to access and use the WebApp solely for personal, non-commercial purposes, in connection with the NFC wristband purchased from us.

2. Ownership

All intellectual property rights in and to the WebApp remain with us. This Agreement does not grant the User any rights of ownership.

3. Functionality and Display

The WebApp allows the User to personalise data linked to the wristband. We make no representations or warranties of any kind, express or implied, that the personalised data or any associated information will be displayed, accessible, or available at any time. No guarantee is provided that the wristband or WebApp will function uninterrupted, error-free, or as intended.

4. Privacy Policy and Data Collection

By using the wristband and WebApp, you acknowledge and agree to our Privacy Policy, including the following:

• Automatic Location Tracking: GPS location data is automatically collected and stored every time your wristband is scanned by any NFC or QR code capable device. This data is retained for 5 years for emergency response, law enforcement cooperation, security, fraud prevention, legal protection, and service improvement purposes.
• Public Access to Medical Information: Anyone with an NFC or QR code capable device can scan your wristband and immediately view the medical information you have chosen to display. No password or authentication is required.
• Law Enforcement Disclosure: Your scan location data may be shared with law enforcement agencies in response to valid legal requests or investigations involving missing persons, criminal activity, or threats to public safety.
• Optional Features: Emergency contact notifications and navigation features are disabled by default and can be enabled or disabled at any time in your account settings.
• Data Retention: Scan records (including GPS location) are retained for 5 years and may be retained longer if involved in active legal proceedings or investigations.
• Account Deletion: Deleting your account will cause your wristband to cease functioning.

You must read and accept the complete Privacy Policy before using this service.

If you do not agree to the data collection and use practices described in the Privacy Policy, you cannot create an account or use this service.

5. Disclaimer of Warranties

The wristband and WebApp are provided "as is" and "as available," without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or availability.

6. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from or relating to the use or inability to use the wristband or WebApp, even if we have been advised of the possibility of such damages.

7. Indemnity

The User agrees to indemnify and hold harmless the Provider from any claims, losses, liabilities, damages, costs, or expenses (including legal fees) arising from the User\'s use or misuse of the wristband or WebApp.

8. Jurisdiction

This Agreement is governed by and construed in accordance with the laws of Queensland, Australia. Any dispute arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Brisbane, Queensland, Australia.

9. Termination

We reserve the right to terminate or suspend access to the WebApp at any time without notice, for any reason, including but not limited to breach of this Agreement or Privacy Policy.

10. Returns and Refunds

To the extent permitted under Australian Consumer Law, we do not offer refunds or accept order cancellations for change of mind. All purchases are considered final once submitted. This includes cases where the User decides they no longer want the wristband, ordered by mistake, or fails to personalise or activate the product.

Nothing in this clause limits your rights under Australian Consumer Law. You are entitled to a replacement or refund if the product is faulty, not as described, or otherwise fails to meet consumer guarantees.

11. Entire Agreement

This Agreement, together with the Privacy Policy and Returns & Refunds Policy, constitutes the entire agreement between the parties and supersedes all prior agreements or understandings, written or oral, relating to its subject matter.

12. User Acknowledgment and Acceptance

By creating an account or using this service, you acknowledge and agree that:

• You have read, understood, and accepted this End User License Agreement in full
• You have read, understood, and accepted the Privacy Policy
• You understand that GPS location data is automatically collected every time your wristband is scanned and stored for 5 years
• You understand that anyone can scan your wristband and view your medical information without authentication
• You understand that scan location data may be shared with law enforcement in response to valid legal requests
• You acknowledge that your wristband will not function if you decline these terms or delete your account
• You are responsible for the accuracy of the medical information you choose to display

ScanMy.Band reserves the right to update this EULA and related policies. Continued use of the service after changes constitutes acceptance of updated terms.
